These Terms of Service govern the rights, obligations, and responsibilities between CodeCraft Co., Ltd. (the "Company") and users of the community service "TOMO" (the "Service").
These Terms take effect upon posting within the Service. Users are deemed to have agreed to these Terms upon registration. The Company may amend these Terms within the scope permitted by applicable laws, with prior notice via in-app announcements.
The Service is available upon app installation via device UUID without a separate registration. Certain advanced features require email verification. Minors must obtain consent from a legal guardian. Minors using paid services or creating groups are deemed to have obtained such consent in advance.
Each user may hold only one account and may not transfer or lend accounts to others. The Company may revoke registration or permanently restrict access in cases of false information or prior violations.
Any user may create a local community group. Minor hosts must operate groups for wholesome purposes. The Company monitors groups operated by minors and may take immediate action if deemed inappropriate. Hosts bear primary responsibility for maintaining healthy communication within their groups.
The Company provides paid services, including the subscription "TOMO PLUS" and single-purchase "Support Tickets." The details regarding the payment and usage of paid services are as follows:
1. Users who wish to use paid services shall pay the usage fee in accordance with the payment methods specified by the Company. The Company does not refund any fees already paid under any circumstances, except in cases where the Service is discontinued or as otherwise provided by applicable laws.
2. Payment methods for the Service shall be in-app billing provided by payment service providers designated by the Company (such as the App Store and Google Play) or other methods. The Company does not issue receipts directly to users; receipt issuance is subject to the policies of the respective payment service provider.
3. Users shall comply with the terms of use regarding the payment method established by the payment service provider, in addition to these Terms, and agree to the payment conditions set by the provider. The payment service provider bills and collects the payment amount on behalf of the Company. Any disputes arising between the user and the payment service provider regarding the payment method shall be resolved under the responsibility of the respective parties.
4. The Company may change usage fees or payment methods for each paid service without prior notice. In such cases, the change shall take effect from the time it is announced or displayed on the Service.
The Company provides features including community boards, chat, and photo albums.
• Chat messages: Retained for a maximum of 3 days after sending, then permanently deleted.
• Images (chat): Retained for 7 days after upload, then automatically deleted.
• Uploaded content: When deleted or modified by the user, original image data is immediately and permanently deleted from the database and AWS S3.
Users must not engage in: MLM/network marketing/religious proselytization/political agitation; posting sexually exploitative or illegal content; harassment, defamation, or stalking; supporting anti-social forces; inducing external payments or forcing contact exchange.
The Company manages personal information in accordance with applicable laws and its Privacy Policy. Communication privacy is generally guaranteed, but the Company may exceptionally review messages in cases of serious violations such as threats to life or child exploitation.
Copyright of user-posted content belongs to the user. However, the Company holds a free license to use such content for service operation, improvement, and promotion.
The Company bears no liability for disputes between users unless due to intentional misconduct. The Company is not liable for data loss due to automatic deletion after retention periods (messages: 3 days / images: 7 days). Compensation, where applicable, is limited to fees paid by the user in the preceding 3 months.
Users may withdraw at any time via the app settings. Upon withdrawal, data is generally destroyed immediately. However, identification information (UUID, etc.) is retained for 3 months to prevent fraudulent use, then permanently deleted.
These Terms are governed by Japanese law. The Tokyo District Court shall have exclusive jurisdiction for disputes.
